Intellectual Property Policy
Protecting creativity and innovation while respecting intellectual property rights across our global marketplace.
Intellectual Property Overview
At Xaysi Inc. Marketplace, we respect intellectual property (IP) rights and aim to operate in compliance with applicable laws. As a marketplace connecting creators, artists, and designers with buyers, we support innovation while protecting rights holders.
This policy describes how to report infringement, how we handle notices and counter notices, and the steps we may take to enforce intellectual property standards on the platform.
Our Commitment
We work to protect both rights holders and legitimate sellers through fair processes and prompt action on valid reports.
Intellectual Property Policy Details
Comprehensive guidelines for intellectual property protection and enforcement on our platform.
1. Xaysi Inc.’s Role
Xaysi Inc. provides a marketplace platform that connects independent sellers and buyers. Sellers are responsible for ensuring their listings, images, descriptions, and shop content do not infringe intellectual property rights.
Xaysi does not manufacture, stock, or ship products on behalf of sellers. We may remove or disable access to content that violates this policy or other applicable terms, and we may take action against repeat offenders.
We do not provide legal advice or determine ownership of IP, but we respond to valid infringement reports by removing or disabling access to allegedly infringing content.
2. Intellectual Property Infringement Reporting
If you believe your intellectual property rights have been violated, you may submit an infringement report through our Reporting Portal. We review reports in line with applicable laws (including the DMCA where relevant) and local legal requirements.
To submit a report:
- Use the Reporting Portal (fastest and most efficient method).
- Provide complete, accurate information submitted in good faith.
- We may request additional documentation (e.g., authorization letters, identity verification).
Regional Reporting Notes
- Canada: Reports are handled through the Reporting Portal in alignment with Canadian law.
- United Kingdom: Reports are processed under applicable U.K. IP laws via the Reporting Portal.
- Ireland: Reports are handled through the Reporting Portal in line with Irish regulations.
- Nigeria: Reports can be submitted through the Reporting Portal following Nigerian IP requirements.
3. Counter Notices
Sellers whose content has been removed may submit a counter notice if they believe the removal was incorrect. Where applicable (including DMCA processes in the U.S.), content may be reinstated after a waiting period (often 10 business days) unless the rights holder initiates legal action.
Regional Counter Notice Notes
- Canada: Counter notices may be submitted where permitted under Canadian law.
- United Kingdom & Ireland: Sellers may submit counter notices under applicable local processes.
- Nigeria: Sellers may submit counter notices if content was removed in error under local requirements.
4. Repeat Infringement
Xaysi Inc. may suspend or terminate accounts of users who repeatedly violate intellectual property rights or who are the subject of multiple valid infringement reports. We may refuse service to users who attempt to bypass enforcement by creating new accounts.
We may suspend or terminate accounts in accordance with our Terms of Use.
5. Withdrawal of Infringement Reports
Only the intellectual property owner or an authorized representative may withdraw an infringement report. Withdrawal requests must include enough details to identify the affected content (e.g., username, shop name, listing URLs).
Withdrawing a report does not automatically restore listings or change account status. We review withdrawals case-by-case and will confirm receipt and notify the seller where appropriate.
6. Resources
If your content has been removed or you want to learn more about IP, we recommend these resources:
